Centers for Medicare and Medicaid Services
Region VII

James Scott and Dee Wills came to give an updated on CMS.

James Scott stated that they are considering different concepts of what may occur with the federal and state budgets and the policy CMS will implement accordingly. James Scott assured the Board of Health that whatever happens, CMS will be ready to deal with it.

Missouri is very innovative with Medicaid and expanding coverage. Mr. Scott noted that there were different concepts floating around out there regarding Medicaid and Medicare, but often times after going through the legislative process the compromise is different then what one originally thought.

Interim Director, Ron Cates addressed the suggested cuts by the Governor, stating they were necessary because over 30% of state revenue would go to Medicaid and there is just not enough money in the state budget to do that. He stated the debate now is not what should we pay for, but what are we already paying for?

Department of Health and Senior Services Update

Ron Cates, Interim Director for the Department of Health and Senior Services, explained to the Board of Health members that Governor Blunt has appointed a 20-member commission to look at the structure of state government for an omnibus reorganization. The members of the commission will then make recommendations to the governor. The commission will be looking at the entire state government structure and not just certain areas. The goal is getting like with like and developing a more cost efficient government.

The board members stated that there were issues going on in the Governor’s office and in the department of which they were not aware.

The Missouri budget has been dependent on “one time money” in the past. One time money is money that can only be used one time, and therefore each year the state would begin the fiscal year in a deficit because the one time money has to be paid back.

The reductions were outlined in the state of the state address except for the 20% reductions from the department. Each department has been asked to submit suggestions to the governor’s office. The governor’s office must approve any recommended reductions. The House and Senate will also be looking to see how to cut the budget.

Legislative Update

Andrew Wankum, the Department’s new legislative liaison, came to give an update on different legislation affecting the DHSS.

A Newborn Screening bill will be introduced that will allow the Department discretion to add tests to the metabolic screening panel. This discretion is needed to consider the validity, reliability and availability of new tests

Meth Bill: The bill will make pseudoephedrine (a key ingredient in the manufacture of methamphetamine) products harder to obtain by being sold by a pharmacist or technician. The buyer would have to present identification and would be recorded in the system. The bill is favored by both Democrats and Republicans. A similar law was passed in Oklahoma and has decreased their meth labs by 80%.

Tort Reform: SB 271 would enact several provisions related to tort reform. The bill has gained a lot of support and looks like it will pass.

The board members stated that they would like updates on legislation that affects the department.

Conference Call Protocol

A memo was sent out articulating Dr. Jantsch’s suggestions for changes in Conference Call Protocol

Dr. Ollie Fischer made a motion to adopt the Conference Call protocol. Dr. Donna Mannello seconded the motion. The motion to accept the Conference Call protocol passed.

Division of Environmental Health and Communicable Disease Prevention Rules

19 CSR 20-1.025 Sanitation of Food Establishments

The new rule changes the definition of what is not a food establishment and changes the hot holding temperature for potentially hazardous foods from 140 ° to 135 ° F.

19 CSR 20-3.050 Sanitation and Safety Standards for Lodging Establishments

The new rule establishes up-to-date sanitation and safety standards regarding life safety, fire safety, electrical wiring, fuel-burning appliances, plumbing and swimming pools and spas.

19 CSR 20-20.080 Duties of Laboratories

The amendment revises the name of the department to reflect it’s current name. The amendment also gives the laboratory specific requirements to report.

19 CSR 20-2.010 Inspection of the Manufacture and Sale of Drugs and Devices

Calling for the rescission of this rule as it is outdated.

19 CSR 20-2.030 The Return and Resale of Drugs and Medicines

Calls for the rescission of this rule as it is outdated and no longer needs to be enforced.

19 CSR 20-1.060 Licensing of Beverage Manufacturers and Distributors and Collection of Inspection Fees

A statute was repealed making the rule no longer necessary.

Flu Vaccine Update

Bryant McNally reported that there have been 1,015 reported cases of the flu thus far this season and that he has heard of school closings due to an outbreak of the flu, but none have been reported.

There is a lot of flu vaccine left over that will be going to waste. The Division of Environmental Health and Communicable Disease Prevention believes that if the vaccine would have arrived two weeks earlier, then more people would have gotten vaccinated.

Syphilis Update

More cases of syphilis were reported this last month than ever was reported in one month period. St. Louis has 14 new cases (10 males and 4 females, 7 were HIV positive). There have also been 6 cases reported in Springfield last month which is equivalent to total cases in 2004.
